Author Topic: Windmill Farms Phase 3 Homeowners Threatened With Liens By Unpaid Contractor  (Read 340 times)

Homeowners living in one of the newest portions of Windmill Farms, Phase 3A, received a letter from Texas Environmental Management SA, Inc. threatening personal liability and a mechanics' and materialmen's lien against their property. This threat comes as Texas Environmental alleges outstanding invoices in the amount of $15,838.35 that Leman Development, the developer responsible for the first 3 phases of Windmill Farms, has not paid.

According to the tracking number listed on the letter, Leman Development received this letter today just before noon. Hopefully they will respond and let the homeowners in Windmill Farms know what has occurred. As Leman has not informed the homeowners about this issue, and did not mention this issue at the Homeowners Association Meeting that occurred just a week ago, all we can do is attempt to draw some conclusions and educated guesses from the two page letter Texas Environmental sent, which appears below (click each page to view a larger version - if your browser scales large images, you may have to click on the full-size version of the image again to make it readable):



It appears that Texas Environmental claims to have had a contract with Leman Development for services in Phase 3A of Windmill Farms. They further claim that they were not paid for some or all of these services. From some quick research, it appears that the company provides erosion control barriers around construction sites (the short black barriers you see along roads near construction sites to keep dirt from washing into the road, etc.) as well as other environmental services.

The claim is about $15,000 - because it's such a relatively small amount for a project of this size, hopefully this issue will be resolved very quickly and easily. No matter what the resolution, the lack of any notice to the homeowners from Leman is very disappointing and confusing.

I'll post an update as soon as I have one. If Leman Development would like to provide an official response to pass on to the homeowners, they may email me at Josh@TwentyPeacefulMinutes.com and I will post it with my next update.
